At Fi, we are committed to keeping your favorite companions safe, happy and healthy – while protecting the privacy and security of your personal information. We strive to be transparent about the information we have, how we protect and use it – starting with our Privacy Policy below.
This Privacy Policy describes how Barking Labs, Corp. (dba Fi) (“Fi”, "Barking Labs," "we", "us" or "our") handles personal information that we collect through our digital properties that link to this Privacy Policy, including our websites (the “Sites”), Fi Collars, and mobile application (the “App,” and collectively with the Sites and Fi Collars the “Service”), as well as through social media, our marketing activities, our live events and other activities described in this Privacy Policy.
We manufacture and sell “smart” dog collars and devices (“Fi Collars”) using geolocation technology to enable our users to track their dogs, behavioral indicators to log their pets’ behaviors and other indicators, and AI technologies to analyze such data and provide insights to our users. We collect and use geolocation information solely to provide you with our tracking services for the Fi Collars. We also never sell personal information to third parties for monetary gain. To the extent Fi uses any data derived from our Services for the development or training of artificial intelligence algorithms or machine learning models, such data will not contain any personal data.
We value the privacy of our users and strive to be transparent about how we collect and use personal information. If you have any questions or concerns with respect to privacy, please do not hesitate to contact us.

3. PERSONAL INFORMATION WE COLLECT
Information you provide to us. Personal information you may provide to us through the Service or otherwise includes:
- Contact data, such as your first and last name, email address, billing and mailing addresses, and phone number.
- Demographic data, such as your city, state, country of residence, and postal code.
- Profile data, such as the username and password that you may set to establish an online account on the Service, photograph, links to your Instagram profile, interests, preferences, information about your dog such as your dog’s name, gender, breed, and ranking, and any other information that you add to your account profile.
- Precise geolocation data, if you authorize our Service to access your device’s location (in order to automatically connect to your Fi Collars), then we will collect your location information to provide you with our Service (i.e., to allow our users to track their pet’s location). The Fi Collars are “smart” which means that, if you expressly opt-in, they will collect location information both passively (e.g., using Wi-Fi access points such as your phone or the Fi charging base, to save energy and maximize battery life) or actively (e.g., using GPS or local Bluetooth beacons).
- Fi Collars data, such as information about your pet’s sleep trends, fitness activity and other behaviors.
- Communications data, based on our exchanges with you, including when you contact us through the Service, communicate with us via chat features, social media, or otherwise.
- Transactional data, such as information relating to or needed to complete your orders on or through the Service, including subscription information, order numbers and transaction history.
- Marketing data, such as your preferences for receiving our marketing communications and details about your engagement with them, including when you sign up for our “Off Leash” newsletter.
- User-generated content data, such as profile pictures, photos, images, ratings, comments, questions, messages, works of authorship, and other content or information that you generate, transmit, or otherwise make available on the Service, as well as associated metadata. Metadata includes information on how, when, where and by whom a piece of content was collected and how that content has been formatted or edited. Metadata also includes information that users can add or can have added to their content, such as keywords, geographical or location information, and other similar data.
- Payment data needed to complete transactions, including payment card information or bank account number.
- Job application data, such as information you submit in connection with an application for a job (including information in a CV, resume or otherwise collected through the job application process).
- Other data not specifically listed here, which we will use as described in this Privacy Policy or as otherwise disclosed at the time of collection.
Third-party sources. We may combine personal information we receive from you with personal information we obtain from other sources, such as:
- Public sources, such as government agencies, public records, social media platforms, and other publicly available sources.
- Third-party services, such as social media services, that you use to log into, or otherwise link to, your Service account. This data may include your username, profile picture and other information associated with your account on that third-party service that is made available to us based on your account settings on that service.
- Third-Party AI Providers. Parts of the Service are integrated with third-party AI platforms (“Third-Party AI Providers”) that help generate outputs (i.e., responses) to your inputs and prompts. These Third-Party AI Providers may infer information about you and share information with us as part of their processing of your inputs and prompts to the Service. Please note, our contracts with such Third-Party AI Providers prohibit them from using your personal data other than to help us provide our Services.
Automatic data collection. We, our service providers, and our business advertising partners may automatically log information about you, your computer or mobile device, and your interaction over time with the Service, our communications and other online services, such as:
- Device data, such as your computer or mobile device’s operating system type and version, manufacturer and model, browser type, screen resolution, RAM and disk size, CPU usage, device type (e.g., phone, tablet), IP address, unique identifiers (including identifiers used for advertising purposes), language settings, mobile device carrier, radio/network information (e.g., Wi-Fi, LTE, 3G), and general location information such as city, state or geographic area.
- Online activity data, such as pages or screens you viewed, how long you spent on a page or screen, the website you visited before browsing to the Service, navigation paths between pages or screens, information about your activity on a page or screen, access times and duration of access, and whether you have opened our emails or clicked links within them.
Cookies and similar technologies. Some of the automatic collection described above is facilitated by cookies and other technologies. For more information, see our Cookie Policy. Where possible, we will also store a record of your preferences in respect of the use of these technologies in connection with the Service.
Data about others. We may offer features that help users invite their friends, dog walkers, or contacts to use the Service, and we may collect contact details about these invitees to process their invitations. Our Service may request access to your contact list to allow us to send invitations. Please do not refer someone to us or share their contact details with us unless you have their permission to do so.
4. HOW WE USE YOUR PERSONAL INFORMATION
We may use your personal information for the following purposes or as otherwise described at the time of collection:
Service delivery and business operations. We may use your personal information to provide you the Services and for our related business operations, including:
- enable us to identify and locate the position of your Fi Collars using location tracking technologies such as Bluetooth, GPS and Wi-Fi;
- provide, operate and improve the Service and our business;
- establish and maintain your user profile on the Service;
- facilitate your invitations to friends, dogwalkers, and other contacts who you want to invite to join the Service;
- facilitate social features of the Service, such as by identifying and suggesting connections with other users of the Service and providing chat or messaging functionality;
- enable security features of the Service, such as by sending you security codes via email or SMS, and remembering devices from which you have previously logged in;
- communicate with you about the Service, including by sending announcements, updates, security alerts, and support and administrative messages;
- communicate with you about events or contests in which you participate;
- understand your needs and interests, and personalize your experience with the Service and our communications; and
- provide support for the Service, and respond to your requests, questions and feedback.
Research and development. We may use your personal information for research and development purposes, including to analyze and improve the Service and our business. As part of these activities, we may create aggregated, de-identified and/or anonymized data from personal information we collect. We make personal information into de-identified or anonymized data by removing information that makes the data personally identifiable to you. We may use this aggregated, de-identified or otherwise anonymized data and share it with third parties for our lawful business purposes, including to analyze and improve the Service and promote our business.
Promotional communications and personalized content delivery. We, our service providers and our third-party advertising partners may collect and use certain of your personal information for marketing and advertising purposes as described below:
- Direct marketing. We may send you direct marketing communications. You may opt-out of our marketing communications as described in the Opt-out of marketing section below.
- Personalized content delivery. Our third-party advertising partners may use cookies and similar technologies to collect information about your interaction (including the data described in the automatic data collection section above) with our Sites, our emails, and other online properties and use that information to serve online ads that they think will interest you. This can also be referred to as targeted advertising. We may also share information about our users with these companies to facilitate personalized content delivery to those or similar users on other online platforms.
To manage our recruiting and process job applications. We may use personal information that we collect in relation to you considering employment with us or publicly available information, to facilitate our recruitment activities and process job applications, such as by evaluating a candidate for a job, and monitoring recruitment statistics.
Service improvement and analytics. We may use your personal information to analyze your usage of the Service, improve the Service, improve the rest of our business, help us understand user activity on the Service, including which pages are most and least visited and how visitors move around the Service, as well as user interactions with our emails, and to develop new products and services. For example, we may use Google Analytics for this purpose. Compliance and protection. We may use your personal information to:
- comply with applicable laws, lawful requests, and legal process, such as to respond to subpoenas or requests from government authorities;
- protect our, your or others’ rights, privacy, safety or property (including by making and defending legal claims);
- audit our internal processes for compliance with legal and contractual requirements or our internal policies;
- enforce the terms and conditions that govern the Service; and
- prevent, identify, investigate and deter fraudulent, harmful, unauthorized, unethical or illegal activity, including cyberattacks and identity theft.
Data sharing in the context of corporate change of control events, we may share certain personal information in the context of actual or prospective corporate change of control events – for more information, see ‘How we share your personal information’ below.
Further uses. In some cases, we may use your personal information for further uses, in which case we will specifically ask for your consent to collect, use or share your personal information if such uses are not compatible with the initial purpose for which information was collected.
Cookies and similar technologies. Some of our automatic data collection is facilitated by cookies and other technologies. For more information, see our Cookie Policy. We will also store a record of your preferences in respect of the use of these technologies in connection with the Service.
Retention. We generally retain personal information to fulfill the purposes for which we collected it, including for the purposes of satisfying any legal, accounting, or reporting requirements, to establish or defend legal claims, or for fraud prevention purposes. To determine the appropriate retention period for personal information, we may consider factors such as the amount, nature, and sensitivity of the personal information, the potential risk of harm from unauthorized use or disclosure of your personal information, the purposes for which we process your personal information and whether we can achieve those purposes through other means, and the applicable legal requirements.
When we no longer require the personal information we have collected about you, we may either delete it or de-identify it.
5. HOW WE SHARE YOUR PERSONAL INFORMATION
We may share your personal information with the following parties and as otherwise described in this Privacy Policy or at the time of collection.
Affiliates. Our corporate parent, subsidiaries, and affiliates, for purposes consistent with this Privacy Policy.
Service providers. We may engage service providers to help power our technologies or perform services on our behalf, including processing, storing, or deidentifying personal information, conducting analytics, AI services to power certain aspects of the Services (such as user input/prompt features, data analytics and recommendations), and other services to provide our Services and manage our business.
Payment processors. Any payment card information you use to make a purchase on the Service is collected and processed directly by our payment processors, such as Stripe and PayPal. They may use your payment data in accordance with their privacy policies, such as https://stripe.com/privacy and https://www.paypal.com/us/webapps/mpp/ua/privacy-full.
Personalized content delivery partners. Third-party advertising companies for the personalized content delivery purposes described above.
Professional advisors. Professional advisors, such as lawyers, auditors, bankers and insurers, where necessary in the course of the professional services that they render to us.
Authorities and others. Law enforcement, government authorities, and private parties, as we believe in good faith to be necessary or appropriate for the compliance and protection purposes described above.
Business transferees. Acquirers and other relevant participants in business transactions (or negotiations of or due diligence for such transactions) involving a corporate divestiture, merger, consolidation, acquisition, reorganization, sale or other disposition of all or any portion of the business or assets of, or equity interests in, our or our affiliates (including, in connection with a bankruptcy or similar proceedings).
Other users and the public. Your profile and other user-generated content data (except for messages between you and us) may be visible to other users of the Service and the public. For example, other users of the Service or the public may have access to your information if you choose to make your profile or other personal information available to them through the Service, such as when you provide comments, reviews, survey responses, or share other content. This information can be seen, collected and used by others, including being cached, copied, screen captured or stored elsewhere by others (e.g., search engines), and we are not responsible for any such use of this information.
In this section, we describe the rights and choices available to all users. Users who are located in certain jurisdictions can find additional information about their rights below.
Access or update your information. If you have registered for an account with us through the Service, you may review and update certain account information by logging into the Service and accessing the account settings section.
Opt-out of marketing communications. You may opt-out of marketing-related emails by following the opt-out or unsubscribe instructions at the bottom of the email, or by contacting us. Please note that if you choose to opt-out of marketing-related emails, you may continue to receive service-related and other non-marketing emails.
Cookies and other technologies. For information about cookies and other technologies employed by the Service and how to control them, see our Cookie Policy.
Linked third-party platforms. If you choose to connect to the Service through your social media account, such as Instagram, or other third-party platform, you may be able to use your settings in your account with that platform to limit the information we receive from it. If you revoke our ability to access information from a third-party platform, that choice will not apply to information that we have already received from that third party.
Edit your content or close your account. You can update or delete certain content through your account. Other information may be necessary for us to provide the Service to you, but you can always request to close your account by contacting us.
The Service may contain links to websites, mobile applications, and other online services operated by third parties. In addition, our content may be integrated into web pages or other online services that are not associated with us. These links and integrations are not an endorsement of, or representation that we are affiliated with, any third party. We do not control websites, mobile applications or online services operated by third parties, and we are not responsible for their actions. We encourage you to read the privacy policies of the other websites, mobile applications and online services you use.
We employ a number of technical, organizational and physical safeguards designed to protect the personal information we collect. However, security risk is inherent in all internet and information technologies, and we cannot guarantee the security of your personal information.
9. INTERNATIONAL DATA TRANSFER
We are headquartered in the United States and may use service providers that operate in other countries. Your personal information may be transferred to the United States or other locations where privacy laws may not be as protective as those in your state, province, or country.
The core Service is not intended for use by anyone under 18 years of age. If you are a parent or guardian of a minor from whom you believe we have collected personal information in a manner prohibited by law, please contact us. If we learn that we have collected personal information through the Service from a minor without the consent of the child’s parent or guardian as required by law, we will seek to delete that information quickly and comply with applicable legal requirements to delete the information.
11. CHANGES TO THIS PRIVACY POLICY
We reserve the right to modify this Privacy Policy at any time. If we make material changes to this Privacy Policy, we will notify you by updating the date of this Privacy Policy and posting it on the Service and, depending on the nature of the change, we might contact you to inform you or ask for your consent. Any modifications to this Privacy Policy will be effective upon our posting the modified version (or as otherwise indicated at the time of posting).

13. STATE PRIVACY RIGHTS NOTICE AT COLLECTION
Except as otherwise provided, this section applies to residents of California, Colorado, Connecticut, Delaware, Iowa, Montana, Nebraska, New Hampshire, New Jersey, Oregon, Tennessee, Texas, Utah, Virginia, and other states to the extent they have privacy laws applicable to us that grant their residents the rights described below (collectively the “State Privacy Laws”).
This section describes how we collect, use, and share for the purposes of targeted advertising Personal Information of residents of these states and the rights these users may have with respect to their Personal Information. Please note that not all rights listed below may be afforded to all users and that if your state does not afford you these rights, you may not be able to exercise these rights. In addition, we may not be able to process your access, correction or deletion request if you do not provide us with sufficient detail to allow us to confirm your identity and understand and respond to your request.
For purposes of this section, the term “Personal Information” means information that relates to an identified or identifiable natural person, or that is reasonably capable of being used to identify, contact, or precisely locate a natural person, household, or a particular computing system or device. In some cases, we may provide a different privacy notice to certain categories of residents of certain states, such as job applicants, in which case that notice will apply instead of this section.
We do not re-identify personal information that is de-identified.
Your privacy rights. You may request to exercise the rights listed below. We will respond to your request in accordance with applicable law.
- Information. You can request the following information about how we have collected and used your Personal Information during the past 12 months:
- The categories of Personal Information that we have collected.
- The categories of sources from which we collected Personal Information.
- The business or commercial purpose for collecting, selling, and/or sharing Personal Information for targeted advertising purposes.
- The categories of personal information that we sold or shared for targeted advertising purposes, and the categories of third parties to whom this information was sold or shared, categorized by the type of personal information for each type of third party.
- The categories of personal information that we disclosed for business purposes and the types of entities to whom this information was disclosed.
- A representative summary of personal data that you have previously provided us.
- Access. You can request a copy of the Personal Information that we have collected about you.
- Correction. You can ask us to correct inaccurate Personal Information that we have collected about you.
- Deletion. You can ask us to delete the Personal Information that we have collected from or about you.
- Opt-out of certain processing. You can opt out of the sharing of your Personal Information for targeted advertising purposes and any other processing deemed a sale under applicable law.
- Opt-out of automated decision making. We do not use your Personal Information to engage in automated processing or profiling.
- Personal Information of Children. If you are under the age to consent to data sharing as applicable based on your jurisdiction (or under 18), please do not attempt to register for the Service or send any personal information about yourself to us. If we learn that we have collected personal information from a child under the age to consent to data sharing, we will delete that information as quickly as possible. If you believe that a child under the age to consent to data sharing may have provided us with Personal Information, please contact us.
- Nondiscrimination. You are entitled to exercise the rights described above free from discrimination as prohibited by applicable law.
- Appeal. You can appeal our denial of any request validly submitted.
Exercising your right to information/know, access, correction, deletion, and appeal. You may submit requests at this form, or by contacting us.
Exercising your right to opt-out of the “sale” or “sharing” of your Personal Information**.** While we do not sell personal information for money, like many companies, we use services that help deliver personalized content to you as described above. The State Privacy Laws may classify our use of some of these services as “selling” or “sharing” your Personal Information with the advertising partners that provide the services. You can opt-out of tracking for targeted advertising purposes or other sales of Personal Information here, by contacting us, or by broadcasting the global privacy control signal.
We cannot process your request if you do not provide us with sufficient detail to allow us to understand and respond to it.
Verification of Identity; Authorized agents. We may need to verify your identity to process your information/know, access, correction, deletion, or appeal requests and reserve the right to confirm your residency. To verify your identity, we may require government identification, a declaration under penalty of perjury or other specific information that we think only you would have, where permitted by law.
Under some State Privacy Laws, you may enable an authorized agent to make a request on your behalf. However, we may need to verify your authorized agent’s identity and authority to act on your behalf. Depending on the kind of request you have made, we may require a copy of a valid power of attorney given to your authorized agent pursuant to applicable law. If you have not provided your agent with such a power of attorney, we may ask you to take additional steps permitted by law to verify that your request is authorized, such as by providing your agent with written and signed permission to exercise your State Privacy Law rights on your behalf, the information we request to verify your identity, or confirmation that you have given the authorized agent permission to submit the request.

We have summarized the Personal Information we collect and may disclose to third parties by reference below to both the categories of Personal Information defined in the “Personal Information we collect” section of this Policy above and the categories of Personal Information specified in state law. This table describes our practices currently and during the 12 months preceding the effective date of this Privacy Policy. Information you voluntarily provide to us, such as in free-form webforms, may contain other categories of personal information not described below.

Additional information for California residents.
- Shine the light law. Under California’s Shine the Light law (California Civil Code Section 1798.83), California residents may ask companies with whom they have formed a business relationship primarily for personal, family or household purposes to provide the names of third parties to which the company has disclosed certain personal information (as defined under the Shine the Light law) during the preceding calendar year for the third party’s own direct marketing purposes, and the categories of personal information disclosed.
